Judgment
ORDER
An urgent application has been filed by the Resolution Professional praying for exclusion of certain dates form the CIR period. The urgency pressed for is because the 270 days expire today. Though a Resolution Plan has been filed, but certain amendments have to be made and accordingly a revised Resolution Plan is required to be filed. The exclusion of dates sought is from 02.11.2018 to 04.11.2018 i.e. the date of Admission of the petition and the date of its communication to the Resolution Professional on 04.11.2018.
In terms of judgment of the Hon'ble NCLAT in the matter of Quinn Logistics India Pvt. Ltd. Vs. Mack Soft Tech Pvt. Ltd. & Ors. (Insolvency) AT No. 185 of 2018, certain periods are permitted to be excluded in computing the CIR period. The exclusion prayed for falls within those permitted as per the decision of the Hon'ble NCLAT. Accordingly, the prayer made by the RP is allowed. Exclusion as prayed for is permitted.
CA 983/ND/2019 stands disposed off in terms of the above.
