Notice. Mr. Pushpender Jaswal, learned Additional Advocate General, accepts notice on behalf of the respondents.

By way of this writ petition, the petitioner has inter alia prayed for the following reliefs:-

“B. That a writ in the nature of Mandamus may kindly be issued thereby directing the respondent-authorities to consider the case of the petitioner and provide/offer him the post of daily waged beldar on compassionate grounds.

C. That a writ in the nature of Mandamus may kindly be issued thereby directing the respondent- authorities to decide the pending representation dated 25.09.2023 (Annexure P-5).”

Learned Counsel for the petitioner submits that father of the petitioner died in harness on 22.01.2012 when the petitioner was a minor. Upon attaining the age of majority, the petitioner made an application to the respondent-Department, for providing employment on compassionate basis. Till date, no decision has been taken by the authorities on this request of his. Accordingly, he submits that the interest of justice would be served, in case, the respondents are directed to pass appropriate order on the representation of the petitioner and offer him appointment on compassionate basis.

Learned Additional Advocate General submits that the application of the petitioner, if in order, shall be decided by the authorities concerned, within a period of six weeks and outcome thereof shall decide as to whether the petitioner indeed is entitled for appointment on compassionate basis or not.

As prayed for, without going into the merit of the issue, this writ petition is disposed of with the direction that the application of the petitioner, which is pending adjudication before the appropriate authority, for appointment on compassionate basis, be decided sympathetically, as per law, as expeditiously as possible and preferably by 28th of February, 2024.

The petition stands disposed of in above terms. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
