Ravindra Maithani, J
Applicant-Sonu @ Makkhi is in judicial custody in FIR/Case Crime No. 557 of 2022, under Sections 148, 149 & 307 IPC, Police Station Bhagwanpur, District Haridwar. He has sought his release on bail.
Heard learned counsel for the parties and perused the record. Learned counsel for the applicant appeared through video conferencing.
In fact, in this case, the applicant has already been granted bail by this Court on 10.01.2023. On that date, the applicant was in custody for the offences under Sections 147, 120B, 302 and 34 IPC. Now, merely because some more Sections 148, 149 & 307 IPC have been added, he has been denied bail.
Having considered, this Court is of the view that the applicant is entitled to be enlarged on bail on the added offences.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
