Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Chitrakonda PS Case No.110 of 2024 corresponding to Spl. GR Case No.99 of 2024 pending in the file of learned Additional Sessions Judge-cum-Spl. Judge, Malkangiri for commission of offences punishable U/Ss. 20(b)(ii)(C)/27-A/29 of the NDPS Act, on the main allegation of possessing of 502 Kgs of Contraband Ganja on the road side near village Khillaguda.
Heard, Mr. Mangu Nandy, learned counsel for the Petitioner in BLAPL No. 2134 of 2026; Mr. Pranab Kumar Das, learned counsel for the Petitioner in BLAPL No. 4650 of 2026 and Mr. R.B. Mishra, learned Addl. PP in these matters and perused the record.
After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-à-vis the accusations sought to be brought against them and regard being had to the recovery and seizure of 502Kgs of Contraband Ganja, which is much more than the commercial quantity allegedly from the possession of the Petitioners and their consequent failure to satisfy the conditions of Sec. 37 of NDPS Act, which is sine qua non for grant of bail for commission of offence under NDPS Act involving commercial quantity, this Court is not inclined to grant bail to the petitioners.
In the result, these two bail applications of the petitioners namely Sonia Golary @ Jetia @ Sania Golary (In BLAPL No.2134 of 2026) and Narayan Nayak (In BLAPL No.4650 of 2026) stand rejected. Accordingly, these BLAPLs stand disposed of. A copy of this order be immediately transmitted to the learned trial Court for reference.
