Sonam Kuntal vs Rahul Singh

The instant writ petition has been filed by the petitioner-wife for seeking direction for early disposal of the Divorce Petition No.134/2020 (titled as Rahul Singh Vs. Sonam Kuntal) filed under Section 13B of the Hindu Marriage Act, 1955 (for short "the Act of 1955"), pending before the Family Court No.1, Bharatpur.

Learned counsel for both the parties submit that the application under Section 13B of the Act of 1955 was filed before the Family Court No.1, Bharatpur on 4th March, 2020 and after registration of the said application, the Court below has fixed 25 th September, 2020 as the next date.

Learned counsel submit that since both the parties want divorce by mutual consent, suitable directions may be given to decide the divorce petition in expeditious manner.

This Court finds that the proceedings, in respect of mutual divorce, can be disposed of by the Court below keeping in mind the urgency of both the parties.

This Court finds that the Court below has already fixed the date of 25th September, 2020 for reconciliation of the parties.

This Court makes it clear that if the reconciliation proceedings do not take place between the parties and there is no settlement, the application filed under Section 13B of the Act of 1955 for mutual divorce needs to be considered for grant of divorce and accordingly, the Court below may dispose of the application, as per law.

With the aforesaid, the present writ petition stands disposed of.
