Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Lachhipur PS Case No.112 of 2026 corresponding to Special GR Case No.65 of 2026 pending in the file of learned Sessions Judge-Cum-Special Judge, Sonepur, for commission of offences punishable U/Ss.20(b)(ii)(B)/29 of NDPS Act, on the main allegation of transporting 5Kgs 900Grams of Contraband Ganja on a TVS Jupiter Scooty bearing Regd. No.OD-17-AD-5025.
Heard, Mr. Laxmi Narayan Patel, learned counsel for the petitioner in BLAPL No.6670 of 2026 and Mr. T.K. Acharya, learned Addl. Public Prosecutor in the matter and perused the record. None appears for the petitioner in BLAPL No.7468 of 2026, but this Court by perusing the record and hearing the counsels Mr. Patel and Mr. Acharya considers it proper to dispose of both these bail applications.
After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-‡-vis the accusations sought to be brought against them and regard being had to the pre-trial detention of the petitioners in custody since 26.05.2026 and the quantity of Contraband Ganja allegedly seized in this case being for intermediate quantity and, thereby, the provisions of Section 37 of NDPS Act being not attractable, this Court without expressing any view on merit admits each of the petitioners to bail.
Hence, these two bail applications of the petitioners namely Somanath Tandi (In BLAPL No.6670 of 2026) and Bapi Nag (In BLAPL No.7468 of 2026) are allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
