The FIR in this case has been lodged by the brother or the deceased by making various allegations. The complainant and his paternal uncle''s son Chet Ram had gone to the house of the inlaws of Smt. Sudesh, his sister, on 18.3.1988 to bring her to village Chholi on account of customary first delivery of the child in the house of the parents of Sudesh. On that day, Sudesh informed the complainant that her husband Vinod Kumar, alongwith Soma Devi and her sisterin law Smt. Krishna, had administered to her a lot of beating and gave her leg kicks in her stomach, causing a lot of pain and that she was not feeling well. Sudesh also expressed her desire to accompany the complainant who requested her inlaws to send her with him so that she could be medically treated. Her inlaws pushed the complainant and his companion out of their house and told him that Sudesh will leave the house only after her death. The complainant and his companion came back. In spite of this information, FIR was lodged only on 20.3.1988. Learned counsel for the petitioner has shown me some letters written by one of the brothers of the deceased and the same do not give any indication of any sort of maltreatment. The petitioner is more than 00 years old. According to medical certificate, she does not look to be enjoying good health.
Keeping the foregoing circumstances in view, I allow bail to the petitioner, to the satisfaction of the Chief Judicial Magistrate, Ambala.
