Judgment
Vishal Dhagat, J
This is second bail application filed by applicant under Section 439 of Code of Criminal Procedure for grant of regular bail relating to FIR No.55/2023, registered at Police Station-Kotwali, District-Shahdol (M.P.) for the offence punishable under Sections 454, 380 and 34 of Indian Penal Code.
Learned counsel appearing for the applicant submitted that applicant is innocent and has falsely been implicated in the case as his father-in-law does not approve of his marriage. It is submitted that applicant does not have any criminal antecedent. Investigation in the case is complete and charge-sheet has been filed. In these circumstances, applicant be enlarged on bail.
Learned Government Advocate appearing for the State opposed the application for grant of bail.
Heard the counsel for the parties.
Considering the seriousness of offence and fact that investigation is complete and charge-sheet has been filed, bail application filed by the applicant is allowed.
It is directed that the applicant shall be released on bail on his furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety in the like amount to the satisfaction of the trial court.
7 . In addition to aforesaid condition, the applicant shall abide by the conditions enumerated in Section 437(3) of Cr.P.C.
