Judgment
MA No. 2846/2023 has been filed by the applicant seeking revival of OA No. 326/2022 which was adjourned sine die vide order dated 25.07.2022. The operative portion of order dated 25.07.2022 reads as under:-
“Accordingly, the matter is adjourned sine die with liberty to the parties to make a motion as and when the lis pending before the Apex Court, is disposed of.”
Now, both the learned counsel for the applicant as well as learned counsel for the respondents have stated that the said SLP No. 4722/2021 Union of India & Anr.
vs. M. Siddaraj has already been finally decided vide judgment dated 11.04.2023. In the said judgment, in para 7 the Hon’ble Apex Court has held as follows :-
“7.In view of the above and for the reasons stated above, the Division Bench of the High Court has rightly directed the appellants to grant one annual increment which the original writ petitioners earned on the last day of their service for rendering their services preceding one year from the date of retirement with good behavior and efficiently. We are in complete agreement with the view taken by the Division Bench of the High Court. Under the circumstances, the present appeal deserves to be dismissed and is accordingly dismissed. However, in the facts and circumstances of the case, there shall be no order as to costs.”
In view of the above, the respondents agreed to consider the case of the applicant in light of the aforementioned decision of the Hon’ble Apex Court. The said exercise shall be completed by the respondents within a period of eight weeks from the date of receipt of a certified copy of this order.
The OA is disposed of in the above terms. MA No. 2846/2023 also stands disposed of accordingly. No costs.
