Judgment
PANKAJ JAIN, J. (ORAL)
[1] The present bunch of writ petitions is directed against Order dated 30.06.2015 (Annexure P-20) passed by the Collector, Thanesar, whereby, on an application filed by the respondents under the Public Premises Act, the petitioners have been ordered to be evicted.
[2] Mr. Bhan, learned Senior Counsel for the petitioners (CWPCWP-18446-2015) is not in a position to dispute that the impugned order is appealable. However, he submits that the present writ petitions were filed before this Court in view of the pendency of similarly situated writ petitions.
[3] Be that as it may, keeping in view that the statute provides a remedy of appeal, the present writ petitions are disposed off with liberty to the petitioners to avail their appropriate alternate remedy in accordance with law.
[4] Keeping in view that the writ petitions are pending before this Court for the last 11 years and that the petitioners were granted interim protection by way of detailed order dated 08.09.2015, the petitioners are granted 04 weeks’ time to avail the appropriate remedy in accordance with law. The order dated 08.09.2015 shall remain in vogue till 01.10.2026.
[5] All miscellaneous application(s), if any, pending before this Court, also stand disposed off.
[6] Photocopy of this order be placed on the file of connected cases.
