Judgment
Ajay Rastogi, J.—This is joint petition filed by 33 Petitioners with the grievance that they all were fixed in the Grade Pay of Rs. 4800/- under 3rd ACP on completion of 27 years of service, details of which have been referred in Schedule-A appended to the writ petition.
Counsel submits that without affording opportunity of hearing to the Petitioners the Government has taken unilateral decision to withdraw the grade pay (supra), reference of which has been specifically made in para 11-B of the writ petition, which is in violation of principles of natural justice
Issue notice of writ & stay petition to the Respondents along with a copy of this order as to why the petition may not be finally disposed of at the stage of admission, returnable by four weeks. Notices may be given ''dasti'', if desired. PF & notices be filed within seven days failing which stay order shall automatically stand vacated without further reference to this Court.
In the meanwhile, Respondents are restrained from taking any action prejudicial to the interest of the Petitioners and reducing their grade pay of Rs. 4800/- which was granted under the 3rd ACP on completion of 27 years of service, detailed of which have been mentioned in Schedule-A appended to the writ petition, without seeking prior permission of this Court and the future recovery, if any initiated from the individual Petitioner till further orders shall remain stayed.
