Judgment
Kurian Joseph, C.J.—The present petition has been filed with the following prayer:
7(i) That respondents 1 and 2 may kindly be directed to regularize the services of the applicants with effect from the dates when they were made as work-charge Beldars in the same post and in the same pay scales as are admissible to the posts which were being held by the applicants on daily wages basis prior to their placement as work-charge Beldars by the respondents-Board with all the consequential benefits/ reliefs or in the alternative their services may kindly be ordered to be regularized against the posts of Helper, Peon with effect from the dates their services have been made as Work-charge.
The stand taken by respondents No. 1 and 2 is that petitioner was not qualified for being regularized. It is seen from the notification dated 20.01.1987 that in the case of those engaged prior to 1985, there was relaxation. This aspect is not seen nor addressed in the reply either. Therefore, there will be direction to first respondent to consider the case of the petitioner for regularization by ignoring the condition regarding educational qualification from the period when he became eligible. The needful shall be done within a period of two months from the date of production of a certified copy of this judgment by the petitioner. The consequential benefits shall be paid to the petitioner within a period of another one month thereafter.
The writ petition stands disposed of, so also the pending application(s), if any.
