Judgment

It is the case of the prosecution that on 13.12.2020, Tanker Truck was found in suspicious condition containing doubtful chemical liquid material
therein and thereafter, the Tanker Truck was seized under Section 41D of the Code of Criminal Procedure, 1973 by Vadodara Taluka Police Station,
Dist.Vadodara and a report was sought from the Environment Department for sample of the material on 18.02.2021. An F.I.R. bearing
No.11197005210247 of 2021 was registered before Vadodara Taluka Police Station, Dist.Vadodara (Rural) for the offences punishable under
Sections 465, 467, 468, 471, 284, 336, 114 of the Indian Penal Code, 1860 and under Sections 7, 8, 15, 16 of the Environment Protection Act.
Learned advocate for the applicant has submitted that the co-accused has already been enlarged on regular bail by 28th Additional Senior Civil
Judge and Additional Chief Judicial Magistrate, Vadodara vide order dated 01.03.2021.
RULE returnable on 07.07.2021. Learned Additional Public Prosecutor waives service of notice of rule on behalf of the respondent â€" State. The
applicant shall not be arrested till date.
It is further clarified that the applicant shall remain present as and when summoned by the Investigating Officer and shall fully co-operate with the
investigation. Appropriate report shall be filed by the Investigating Officer on or before the next date of hearing.
