Judgment
In this petition, the Petitioners have made the following prayer:
To direct the Respondents to effectively implement the policy of 27% reservation for OBC candidates under Article 15(5) of the constitution and under relevant provisions of Central Educational Institution (Reservation in Admission) Act No. 5 of 2007 in accordance with the direction of order of High Court of Delhi in Apoorva's case (annexed as Annexure P-3) and Tanvi Yadav's (annexed as Annexure P-4) in the petition which is binding against the Respondents as they have not filed any appeal against the said two judgments to the knowledge of the Petitioners.
Declare the notification bearing No. Aca.I/2011-12 issued by the University of Delhi dt. 19.4.11 prescribing the admission process/ policy/ guidelines for the under-graduate students admission process to be followed in Academic Session 2011-12 for OBC candidates being vague, unclear and not in accordance with the requirement of reliefs prayed in Para 1 of the prayer herein.
Issue a fresh notification for Undergraduate Students admission process to be followed in the Academic Session 2011-12 incorporating clear terms for complying with the prayer made in Para 1 and 2 herein prayed in the writ petition before the admission process is started.
Any other relief/reliefs as your lordships deem, just, fit and proper in the interest of justice.
After making some submissions, learned Counsel for the Petitioners made a request that his clients may be permitted to withdraw this petition with liberty to move the High Court for appropriate relief.
The request of the learned Counsel is accepted and the writ petition is dismissed as withdrawn with liberty in terms of the prayer made.
It is made clear that this Court has not expressed any opinion on the merits or demerits of the Petitioners' cause and the writ petition, if any, filed by them shall be decided by the High Court on its own merits.
