Sneha Singh vs Union Of India & Others

Petitioner passed Secondary School Examination (10th standard) and Senior Secondary Examination (12th standard) from National Institute of Open Schooling (NIOS).

Petitioner wants correction of her name as Sneha Singh, which has been recorded as Snehlata Singh in the certificates issued by National Institute of Open Schooling. She also wants her date of birth to be corrected as 28.12.1994 in place of 28.08.1991.

Hon'ble Supreme Court in the case of Jigya Yadav v. Central Board of Secondary Education & others in Civil Appeal No. 3905 of 2011 has issued certain directions to Education Boards for dealing with the request for correction in the name and date of birth in educational certificates of the students.

Mr. Shashank Upadhyay, learned counsel appearing for National Institute of Open Schooling very fairly submits that if petitioner makes representation for correction of her particulars in the Educational Certificates issued by National Institute of Open Schooling, then the Competent Authority shall consider her request in terms of the law laid down by Hon'ble Supreme Court in the case of Jigya Yadav (supra) and take appropriate decision at the earliest.

Accordingly, the writ petition is disposed of with liberty to petitioner to make representation to the Competent Authority in National Institute of Open Schooling, within two weeks from today. If such representation is made by the petitioner, the Competent Authority in National Institute of Open Schooling shall consider petitioner's request and pass appropriate order, in accordance with law, as early as possible, but, not later than eight weeks from the date of production of certified copy of this order along with copy of the representation.

Let a certified copy of this order be issued by 30.11.2021.
