Judgment

5 paragraphs · 199 words
1.

Heard the learned counsel appearing for the parties.

2.

This appeal is directed against the Judgment and Order passed by the Motor Accident Claims Tribunal - IX, Harapanahalli [the ''Tribunal'', for short] in MVC No.148/2009.

3.

The claimant is in appeal seeking for enhancement of compensation challenging the judgment and order of the Tribunal, awarding compensation of Rs.6,000/- globally with interest at the rate of 6% per annum from the date of the petition till the compensation.

4.

The factum of accident and the injuries sustained by the claimant is not in dispute. The claimant sought for compensation towards the injuries sustained by her in the road traffic accident which occurred on 08.12.2006 alleging the actionable negligence on the driver of the tractor-trailer bearing registration No.KA-35/T-5515-16. It is discernable from the wound certificate at Ex.P7 that the claimant had sustained only three simple injuries. No substantial evidence was placed on record to establish any grievous injuries or any disability suffered by the claimant. In the circumstances, the Tribunal considering the evidence on record, awarded compensation of Rs.6,000/- with interest at the rate of 6% per annum which is justifiable.

There is no merit in the appeal. Hence, dismissed.
