Judgment
The writ petition has been filed with a prayer to grant permanent appointment to the writ petitioner to the post of Chowkidar under Barato Veterinary Dispensary in lieu of the donation of land made by the family.
Mr. S.Dey, learned counsel for the petitioner submits that as per the prevalent scheme, when a donation of land is made to the government, a member of the family is afforded employment, which falls outside the purview of the District Selection Committee. He submits that though the petitioner has been given contractual appointment, her permanent employment or regularisation, is yet to be processed by the respondents. He therefore, prays that appropriate directions be issued for expeditious disposal of the petitioner’s case for regularisation.
Ms. R.Colney, learned GA appearing for the respondents, does not dispute the facts as placed by the learned counsel for the petitioner, but submits that as due process will take some time, perhaps the matter can be disposed of with a direction that the case of the petitioner be considered as per the guidelines, and by directing the respondents to complete the entire process within a period of six months.
On hearing the learned counsel for the parties and on perusal of the materials, it is noted that there is a Gift Deed dated 21st August, 2023, in favour of the respondent department which would make the petitioner eligible for consideration. Further, this Court notes that as per the Office Memorandum dated 17th November, 2014 at clause 7 thereof, the procedure has been prescribed therein, for the manner in which regularisation is to be accorded in such cases.
The petitioner, it is seen, has been on contractual service since 16-06-2023 and has continued till 31-08-2026.
Accordingly, in view of the submissions and discussions made hereinabove, this writ petition is disposed of with directions that the respondents process the case of the petitioner and complete the exercise within six months. The petitioner, till such exercise is completed, shall not be removed from the present post.
Accordingly, as directed, matter stands closed and disposed of.
