The petitioner has filed the present petition challenging the order No. Com/Trans/WB/147, dated 2nd September, 2015 issued by the

Commissioner of Transport, Meghalaya, Shillong and order dated 4th September, 2015 for taking over of M/s Momin Weighbridge at Sarangma,

North Garo Hills.

At the outset, Mr. P.T. Sangma, learned counsel appearing on behalf of petitioner submits that the petitioner had filed an appeal dated 10th

September, 2015 before the Grievances Redressal Committee, Transport Department, Government of Meghalaya (Annexure-15) against the

impugned order dated 2nd September, 2015 and the appeal is pending. No order on the said appeal has been passed by respondent No. 2.

Mr. H. Kharmih, learned counsel appearing on behalf of respondents submits that the appeal dated 10th September, 2015 filed by the petitioner

is pending and the respondent No. 2 will decide the same within a period of 1(one) month after hearing the petitioner.

Mr. P.T. Sangma, learned counsel for petitioner submits that he is satisfied with the same and he may be permitted to withdraw the present

petition. Learned counsel for petitioner has filed a separate application in this regard.

In view of the facts and circumstances of the case and submission made by learned counsel for the petitioner, the present writ petition is

dismissed as withdrawn. However, the respondent No. 2 is directed to decide the appeal filed by petitioner within one month, after affording

opportunity of hearing to the petitioner.
