This matter is taken up through Hybrid Mode.
Heard Mr. S.K. Tripathy, learned counsel appearing for the applicant as well as Mr. A.Kejriwal, learned counsel appearing for the opposite party.
This is an application for maintenance pendent lite and expenses of the litigation.
Mr. Tripathy, learned counsel has categorically stated that after the decree of divorce has been passed with an order of alimony to the extent of Rs.15,00,000/-, the appellant has not been getting any amount from the opposite party for her maintenance.
But Mr. Tripathy, learned counsel has admitted that the opposite party has deposited a sum of Rs.15,00,000/- before the Judge, Family Court by two drafts, but the applicant has not drawn any amount out of the said deposit.
Having regard to the circumstances, particularly the incidence of deposit of Rs.15,00,000/-, this court would direct payment of Rs.25,000/- as the litigation expenses to the applicant by the opposite party by 15.06.2023. We would like to make it abundantly clear that if this amount is not paid within the date as prescribed by us, we may scrap the right of audience of the opposite party in the appeal being MATA No. 64 of 2022.
Let the matter be listed on 27.06.2023 for disposal on merit, subject to payment, as directed by us today in I.A. No. 100 of 2023.
