Rakesh Kumar Jain, J.—This revision petition is directed against order dated 16.2.2011 by which an application filed by the landlord for seeking ejectment of the tenant on the ground that he has not filed an application within 15 days from the date of service for seeking leave to defend, therefore, he should be directed to be evicted from the demised premises, has been dismissed by the learned Rent Controller on the ground that his application filed u/s 13-B of the East Punjab Urban Rent Restriction Act, 1949 (for short ''the Act) is a composite application as grounds which are available for an application filed u/s 13 of the Act have also been taken.

At the very outset, learned Counsel for the Petitioner has submitted that his application filed u/s 13-B of the Act may be treated as an application filed u/s 13 of the Act. In this manner, he would be able to proceed with this application for seeking eviction of the tenant.

In view the aforesaid statement, application filed u/s 13-B of the Act by the landlord be treated as an application filed u/s 13 of the Act and be decided accordingly.

Revision petition is thus, disposed of.
