Judgment
The petitioner is the dependent mother of deceased employee Late Shri Natwar Mohbe, who was working as a Trade Constable and died in harness on 27.06.2026.
Learned counsel appearing for the petitioner submits that the petitioner, being the dependent mother of the deceased employee, has submitted a representation/objection (Annexure P-4) before respondent No.5, who is the competent authority to consider an application for compassionate appointment moved by the family members of the deceased employee. Learned counsel for the petitioner submits that the petitioner apprehends that the application for compassionate appointment, if submitted by respondent Nos.6 and 7, may be considered without taking into consideration the claim and objection raised by the petitioner. He, therefore, prays that the present writ petition may be disposed of with a direction to respondent No.5 to consider and decide the representation/objection submitted by the petitioner vide Annexure P-4 before considering any application for compassionate appointment, if made by respondent Nos.6 and 7.
Learned State counsel submits that as, the petitioner has already submitted a representation/objection before respondent No.5, the same shall be duly considered by the competent authority in accordance with law before consideration of any application for compassionate appointment submitted by the family members of the deceased employee.
I have heard learned counsel for the parties and perused the material available on record.
In view of the submissions made by learned counsel for the parties, the present writ petition is disposed of with a limited direction that, in the event any application for compassionate appointment is submitted by respondent Nos.6 and 7, the competent authority/respondent No.5 shall, before considering such application, take into consideration the representation/objection submitted by the petitioner vide Annexure P-4.
While considering the aforesaid representation/objection and the application for compassionate appointment, respondent No.5 shall afford an opportunity of hearing to all concerned parties and thereafter pass an appropriate and reasoned order in accordance with law.
It is made clear that this Court has not expressed any opinion on the merits of the respective claims of the parties, and the competent authority shall consider the same independently in accordance with the applicable rules governing compassionate appointment.
With the aforesaid observation and direction, the present writ petition stands disposed of.
