Judgment
Mr. Sarangi, learned senior advocate appears on behalf of petitioner and submits, his client is a lady, residing with her family in a slum. She faces eviction. He submits, his client has ration card and electric supply at her dwelling. He seeks interim protection, in event hearing of the writ petition is adjourned.
Mr. Pradhan, learned advocate appears on behalf of private opposite party no.9. He submits, the land has been allotted to his client by Industrial Development Corporation of Odisha (IDCO), on payment of good consideration. He points out from annexures to the writ petition, firstly, petitioner has disclosed Aadhaar card, where her residence is given as Plot no.22/B, Sahid Nagar. Secondly, the electricity bill is in name of some other person. Mr. Sarangi replies, his client has disclosed ration card, which shows the dwelling as her address and the electricity bill is in name of her father-in-law.
Mr. Rout, learned advocate, Additional Standing Counsel appears on behalf of State.
It appears, earlier there was writ petition W.P.(C) no.14551 of 2022, in which husband of petitioner was one of the petitioners. By order dated 14th September, 2022, the writ petition was disposed of on observing, inter alia, fact remains petitioners were in unauthorized occupation of the land and if any action will be taken for eviction, due procedure of law is to be followed. Hence, the petition was disposed of as premature.
We find, ration card of petitioner was issued on 1st July, 2016 and her Aadhaar card has indication of having been issuing in year 2017. Prima facie, it appears, the husband has obtained rehabilitation and now the wife has come to Court.
Petitioner will be further heard, as a last chance, on admission of the writ petition.
