Judgment
Prafulla C. Pant, J.—Heard.
By means of this writ petition moved under Article 226 of Constitution of India, the Petitioners have sought writ in the nature of mandamus directing the Respondent Nos. 1 and 2, to provide the protection of life and liberty to the Petitioners.
Learned Counsel for the Petitioners submitted that the both the Petitioners Shaloo and Vikash Kumar are major. They got married to each other on 17.05.2011 against the wishes of Respondent Nos. 3 to 7. In support of factum relating to age, copy of High School Mark sheet, as well as copy of High School certificate of the girl are Annexed as Annexure-2 to the petition. Copy of marriage certificate is Annexed as Annexure 1 to the petition.
Admit the petition.
Learned Counsel for the State prays for and is allowed six weeks time to file the counter affidavit.
Issue notice to Respondent No. 3 Monee Kashyap, Respondent No. 4 Rakesh Kumar Kashyap, Respondent No. 5 Anup Kumar Kashyap, Respondent No. 6 Mohit Kumar Kashyap and Respondent No. 7 Ajay Kumar Kashyap, who may also file their counter affidavits within a period of six weeks.
Having considered submissions of learned Counsel for the Petitioners, and learned Counsel for the State, as an interim measure, it is directed that on making application by the Petitioners before Respondent No. 2 Station House Officer, Kotwali, Hardwar, the Petitioners Shaloo and Vikash Kumar shall be provided necessary protection. (Interim Relief Application No. 6650 of 2011 stands disposed of).
List after six weeks.
