Judgment
This petition under Section 482 of the Code of Criminal Pro-cedure has been preferred by the petitioner seeking direction to the sub-ordinate courts for directing them to get certain information from the parties on their respective affidavits with a view to dispose of an application for maintenance speedily and is just manner in the light of the judgments passed between the parties Kusum Sharma vs. Mahin-der Kumar Sharma by the Delhi High Court in FAO No.369/1996 decided on 14-1-2015 {AIR 2015 DELHI 53} and in FAO No.369/1996 decided on 6-12-2017 { I (2018) DMC 1 (Del.)}
On perusal of the judgments of the Delhi High Court, it is found that format approved by the Delhi High Court is very lengthy and complicated. Considering the requirements of metro city, the situation in the Madhya Pradesh is entirely different and therefore, the same can-not be followed here.
This court has taken assistance of Amicus curiae, retired learned District Judge, Shri S. N. Khare, Judge, who has redrafted the draft of affidavit. Before finalizing the same and passing any order, in view of this court, it would be appropriate to invite suggestions from the judicial officers of certain district of the Madhya Pradesh so that this court may come to a right conclusion with regard to format of the affi-davit.
Hence, office is directed to send a copy of the draft (Annex-ure-A) prepared by Shri S. N. Khare to the District Judges and Principal Judge of the Family Courts of the Madhya Pradesh, like Jabalpur, In-dore, Bhopal, Gwalior, Umaria, Tikamgarh, Mandla, Guna, Sidhi, Tikam-garh and invite suggestions with regard to approval of the aforesaid draft with a request that the District Judges and Principal Judge of the Family Courts shall take suggestions of other Judges / Judicial officers posted in their districts and consolidated suggestions be sent to this Court within a period of fifteen days from the date of receipt of draft (Annexure-A).
List the case for further orders on 27.4.2020.
