Hon’ble Siddhartha Sah, J. (Oral)

By means of the present writ petition, the petitioner has sought expeditious disposal of Election Petition No.05 of 2025 within a time bound manner.

2.

Heard learned counsel for the parties and perused the record.

3.

At the very outset, the Court made a query to the learned counsel for the petitioner as well as learned counsel for the respondent as to under which provision of the Uttarakhand Panchayati Raj Act, 2016 (“the Panchayati Raj Act”), there is a timeline fixed for deciding an election petition.

4.

Learned counsel for the parties states that there is no specific provision, however reference is being made to Section 86 of the Representation of People’s Act, 1951 (“the 1951 Act”) for seeking the expeditious disposal of the election petition.

5.

Since, there is no specific timeline fixed in the Panchayati Raj Act, the ends of justice would be better served by directing the Sub Divisional Magistrate, Kalsi, District Dehradun to expedite the hearing of the Election Petition No.5 of 2025 keeping in mind Section 86 of 1951 Act.

6.

With the said observation the writ petition stands disposed of.
