Heard Mr.N.K.Barik, learned counsel for the petitioner. In this Criminal Revision, the petitioner has challenged the order dated 17.9.2021 passed by the learned Sub-Divisional Magistrate, Bhubaneswar in I.C.C. Case No.3733 of 2020 (Annexure-5) granting bail to the opp. party in a case registered for commission of offences punishable under Sections 420, 465, 423, 468, 471 and 506 of I.P.C.
In support of his submissions that the order has been passed mechanically and hastily without hearing the complainant for which the order is liable to be set aside, Mr. N.K.Barik, learned counsel for the petitioner relies on the decisions reported in AIR 2010 SC 802 (Subodh Kumar Yadav v. State of Bihar and another), AIR 2009 SC 1021 (Brij Nandan Jaiswal v. Munna @ Munna Jaiswal and another), AIR 2013 SC 296 (Kanwar Singh Meena v. State of Rajasthan and another), (2001) 6 SCC 338 (Puran v. Rambilas and another) and (2002) 3 SCC 598 (Ram Govind Upadhyay v. Sudarshan Singh and others).
