The writ petition, in W.P. No. 8248 of 2011, has been filed praying that this Court may be pleased to issue a writ of Certiorari to call for and quash the impugned notice, dated 18.3.2011, issued by the respondent.
The Contempt Petition, in Contempt Petition No. 1339of 2011, has been filed to punish the respondents for committing contempt of Court by wantonly and willfully disobeying the order passed by this Court, in Contempt Petition No. 401 of 2011, in W.P. No. 27844 of 2010, dated 28.4.2011 and to punish the respondents for their disobedience.
It has been stated that through the impugned notice, dated 18.3.2011, issued by the Assistant Engineer, the Tamil Nadu Slum Clearance Board, sub-division-2,division-5, Chennai, the petitioner in W.P. No. 8248 of 2011,has been asked to show cause as to why an appropriate action should not be taken against her, with regard to the alleged encroachment, said to have been made by the petitioner, as stated in the said notice. Fifteen days time had been given to the petitioner to remove the encroachment and on her failure to do so, it had been stated that the respondent would take appropriate action to remove the encroachment and to recover the costs from the petitioner. This Court, while admitting the writ petition, on 31.3.2011, had granted an order of interim stay of the said notice.
At this stage of the hearing of the writ petition and the contempt petition, the learned counsel appearing on behalf of the respondent had submitted that in view of the interim order of the stay granted by this Court, by its order, dated 31.3.2011, no action could be taken against the petitioner in the writ petition, in W.P. No. 8248 of 2011, as directed by this Court, by its order, dated28.4.2011, in W.P. No. 27844 of 2010 and W.P. No. 27859 of2010. However, the learned counsel appearing on behalf of the respondent had submitted that fresh notices would be issued to the petitioner, in W.P. No. 8248 of 2011, the petitioner in Contempt Petition No. 1339 of 2011 and the other alleged encroachers in the area in question in F-Block and in the other blocks in Ramakrishnapuram, T. Nagar, Chennai, and appropriate action would be taken against them, on merits and in accordance with law, as the respondent deems fit and proper.
In such circumstances, this Court finds it appropriate to close the writ petition, in W.P. No. 8248 of 2011 and the contempt petition in Contempt Petition No. 1339 of 2011, as no further orders are necessary. No costs. Connected M.P. No. 1 of 2011 is closed.
