Judgment
Learned Counsel appearing for the cross objectors submits that the appeal in MFA No.4394/2016 in which this cross objection is preferred has been dismissed on 20.06.2017. He further submits that the award impugned in this cross objection is passed under Section 8 of the MFA CROB No.14/2017 Requisitioning and Acquisition of Immovable Property Act, 1952 (''the Act''). In view of dismissal of the appeal before it being admitted, he seeks leave to convert this cross objection into an appeal under Section 11 of the Act.
Subject to all just exceptions, leave sought for is granted. The cross objectors are permitted to convert this cross objection into an appeal under Section 11 of the Act by making appropriate corrections in the memorandum of cross objection and by paying the requisite Court fee payable on the appeal. On such conversion, list the appeal for orders on 11.07.2017 as prayed for. The cross objection is accordingly disposed of. In view of disposal of the cross objection, IA Nos.1, 2 & 3 of 2017 do not survive for consideration; they stand disposed of accordingly.
