Judgment
In this petition filed under Article 226 of the Constitution, the petitioner has prayed for a writ of mandamus directing the respondents to consider the application for withdrawal of resignation dated 14.10.2016 by taking into account the recommendation (Annexure-P/10) dated 17.10.2016.
Admittedly, the petitioner was appointed on contract basis on 18.09.2013. He tendered his resignation on 05.08.2016 (Annexure-P/3). Later on, he intended to withdraw the resignation on 14.10.2016. The General Manager (BOT) of respondent-Corporation recommended his case before the Assistant General Manager (Establishment).
Since petitioner''s representation seeking withdrawal of resignation or for giving fresh liberty is pending consideration before respondent Nos.2 & 3, I am not inclined to decide the matter at this stage on merit.
Accordingly, this petition is disposed of by directing the petitioner to file his representation along with recommendation dated 17.10.2016 (Annexure-P/10) before the respondent Nos.2 & 3.
In turn, the said respondents shall consider and decide the said representation in accordance with law within 45 days. The outcome shall be communicated to the petitioner.
The petition is disposed of without expressing any view on the merits of the case.
