Aravind Kumar, J.—This appeal is directed against the order passed by 28th Additional City Civil Judge, Bangalore dated 18.9.2008 rejecting the application filed by the plaintiff under Order 39 Rule 1 and 2 whereunder plaintiff sought for an order of temporary injunction to restrain defendants 1 to 9 their agents/representatives or any other person claiming through or under them from alienating of encumbering or leasing/letting out all or any portion of suit schedule property to any third parties pending disposal of the suit.

By consent of the learned advocates appearing for parties namely Sri. K. Suman, for the appellant and Sri. R. Narayana for respondents 1, 3 and 4 this appeal is being disposed of by directing the trial Court to dispose of the suit in question within a period of eight months from the date of receipt of the copy of this order and the order made by this Court on 18-12-2006 whereunder pending decision of I.A. No. 1 in this appeal the respondents were restrained from alienating the suit schedule property, would continue till the disposal of the suit. It is made clear that parties shall co-operate with the trial Court in expeditious disposing of the case and snail not create any hurdles in this regard. With this observation the appeal is disposed of. Ordered accordingly.
