Judgment
H.G. Ramesh, J.—This petition is by the wife u/s 24 of the Code of Civil Procedure, seeking transfer of the proceeding in M.C.No.1311/2010 and another proceeding in G & W No. 103/2010 pending before the Court of the II Additional Judge, Family Court, Bangalore, to the Family Court, Shimoga.
I have heard the learned Counsel for the parties and perused the averments made in the petition and also the statement of objections.
It is not in dispute that Bangalore is at a distance of about 275 kilometers from B. Beeranahalli, Shimoga taluk wherein she is presently residing with her parents along with a child aged 21/2 years. It is stated that the other child is living with the respondent - husband.
Learned Counsel appearing for the petitioner submitted that it would cause great hardship to the petitioner - wife to travel a long distance of 275 kilometers along with her minor child aged about 21/2 years to attend the proceedings at Bangalore.
On the facts of the case, I deem it appropriate to transfer the aforesaid two proceedings to the Family Court at Shimoga. Ordered accordingly.
