Petitioner has filed this writ petition seeking following reliefs:-

"10.1

That, this Hon’ble Court may kindly be pleased to issue a writ/writs, order/orders, direction/directions to the respondent No. 4-Municipal Corporation, Rajnandgaon to release the GPF which has already been determined by Annexure P/3 with 12% interest on delayed payment from date of death till actual payment.

10.2

Any other relief, which may deem fit may also be awarded along with cost of the petition."

Learned counsel for the petitioner submits that the husband of the petitioner, while working as Assistant Revenue Inspector in the Municipal Corporation, Rajnandgaon, died on 24.02.2021. It is submitted that thereafter the respondents have already sanctioned/fixed the pension of the petitioner vide order dated 20.09.2021 and the petitioner is receiving the same. However, the General Provident Fund (GPF) amount payable to the petitioner has not been disbursed till date, despite the fact that the said amount has already been calculated by the Municipal Corporation, Rajnandgaon at Rs.6,79,599/-. Learned counsel for the petitioner further submits that a direction be issued to the respondents to release the admitted GPF amount payable to the petitioner along with interest, in accordance with law.

Learned counsel appearing for the respondents submits that he has sought instructions from the concerned authorities. He submits that the claim of the petitioner with regard to the GPF amount shall be considered by the competent authority and, on instructions, submits that the respondents shall take appropriate decision and release the amount, if found payable, in accordance with law.

On due consideration of nature of grievance raised, submission made by learned counsel for respective parties, this writ petition at this stage is dispose off, directing Respondents to consider and take decision on the claim of petitioner and to disburse the retiral dues for which petitioner is entitled, in accordance with law, within a further period of 03 months from today.

It is for the counsel for respondents to inform the respondents about passing of order by this Court.

With the aforesaid observation and direction, this writ petition is disposed of.
