Judgment
H.G. Ramesh, J.—There is a delay of more than one year and four months (495 days) in filing the appeal. However, in the interest of justice, I have heard the learned counsel appearing for the appellant on the merits of the appeal and perused the impugned judgment.
This appeal is by the claimant seeking for enhancement of the compensation awarded by the Tribunal. By the impugned judgment, the Tribunal has awarded a compensation of Rs. 1,45,000/- to the appellant for the injuries sustained by her in a motor vehicle accident that occurred on 24.05.2009. As could be seen from the impugned judgment, the appellant had suffered fracture of left superior pubic rami, fracture of left ankle and a lacerated injury to the index finger.
The Tribunal has assessed the compensation under the following heads:
The appellant got treated in St. John''s Medical College Hospital which is a well known hospital in Bangalore. The appellant has not produced any disability certificate from the said hospital and no doctor from that hospital was examined in support of the claim. However, the appellant got examined a doctor from Victoria hospital and admittedly he was not the doctor who treated the appellant.
On the facts of the case, in my opinion, the compensation assessed by the Tribunal at Rs. 1,45,000/- cannot be said to be on the lower side to warrant any enhancement. Hence, both I.A. No. 1/2012 and the appeal are dismissed.
Appeal dismissed.
