Heard Mr. Lokendra Dobhal, Advocate for the applicant and Mr. J.S. Virk, AGA, for the State of Uttarakhand.

The applicant is in jail having been implicated in Case Crime No.54 of 2018, which has been registered under Sections 420 and 120-B of IPC and

under Section 24 of Emigration Act, 1983, at Police Station â€" Muni Ki Reti, District â€" Tehri Garhwal.

As per the first information report, the allegation is against the husband of the applicant that he was indulged in human trafficking and he used to send

young boys and girls to foreign countries on pretext of providing them a job in these countries. The husband of the applicant is already in jail. Learned

counsel for the applicant submits that the applicant was not named in the first information report and she has been falsely implicated in the present

case.

Considering the above facts, prima facie, the applicant has been able to make out a case for bail. One of the reasons that this Court is inclined to grant

bail to the applicant is that there is a special provision under proviso to sub-section (1) to Section 437 of CrPC. The bail application is allowed

accordingly.

Let the applicant be enlarged on bail in the aforesaid crime on her executing a personal bond and two reliable sureties each of the equal amount to the

satisfaction of the court concerned.

It is made clear that any observation made by this Court is only for the purpose of deciding the present bail application. It shall not be taken into

consideration at all in any other proceedings.
