Judgment
Hon''ble Arvind Kumar Tripathi, J.—Heard learned counsel for the petitioners, learned counsel for respondents No. 5 and 6, learned AGA for the State and perused the record.
The present habeas corpus writ petition has been filed on behalf of petitioner Neetoo Verma, daughter of Dharamraj Verma, through her alleged husband Mahadev, petitioner No. 2.
The contention on behalf of petitioner is that petitioner No. 1. Smt. Neetoo Verma was major. The marriage was performed on her own sweet will with petitioner No. 2. Mahadev on 31.07.2011 in the temple of Goddess Durga at District Sultanpur City. Subsequently, she was illegally detained by her maternal grand father and maternal uncle, respondent No. 5 and 6. After death of her mother, her father remarried and she was living along with her maternal grandfather and maternal uncle.
In compliance of the order dated 21.10.2011 and 04.01.2012, the corpus Neetoo, petitioner No. 1 was produced before this Court. In compliance of the aforesaid order, a draft for a sum of Rs. 5,000/- has also been deposited with the registry.
Today, the petitioner No 1 came along with her maternal uncle Surya Bhanu Verma. Statement of petitioner No. 1 was recorded. There is no dispute in between the parties that the petitioner Neetoo Verma is major. According to her statement, her mother is not alive. Her father remarried. She is living along with her maternal grandfather. She stated that the marriage was performed against her wishes along with petitioner No. 2 Mahadev. She is living along with her maternal uncle and maternal grandfather on her own sweet will and she want to go back along with her maternal uncle.
Considered the submission, facts and circumstances of the case, In view of the statement of petitioner Neetoo Verma, she is not illegally detained by respondent No. 5 and 6. Admittedly, she is major and she wants to go along with her maternal uncle. She is free to go along with her maternal uncle.
Accordingly, the present habeas corpus writ petition is dismissed.
The draft for a sum of Rs. 5,000/- shall be handed over to petitioner Neetoo Verma or to her counsel.
