Smt. Meera Sharma vs State of U.P. and Another

R.K. Singh, J.—Heard Mr. D.K. Singh holding brief of Sri N.N. Singh, counsel for the revisionist and Sri Lokendra Dobhal counsel for the opposite party No. 2 and the learned A.G.A. perused the impugned judgment and order passed by the Additional District & Sessions Judge, Dehradun in Criminal Revision No. 174 of 1982, dated 16th June. 1984. Also perused the trial Magistrate''s judgment passed by the 2nd Judicial Magistrate. Dehradun in Criminal Misc. Case No. 18 of 1982, dated 13th December, 1982.

Learned Additional District & Sessions Judge has analysed the evidence of applicant Smt. Meera Sharma in all relevant perspectives. The learned Additional District & Sessions Judge has recorded a definite finding that the applicant has wilfully deserted her husband without any proper reason. This Court does not find any weakness in this finding. The learned Counsel for the revisionist has failed to make out any good ground to assail this finding recorded by the learned Additional District & Sessions Judge holding that the revisionist has deserted her husband without sufficient reasons.

The prayer for maintenance of the revisionist against him (Respondent No. 2) is bound to be refused because there is clear finding that she has deserted her husband without sufficient reasons. The revision petition does not disclose merit and the same is accordingly dismissed.
