Judgment
This Criminal Petition is filed under Section 482 of the Criminal Procedure Code praying that this Hon''ble Court may be pleased to set aside the orders dated 18-10-1995 passed by the XXIII Additional City Civil and Sessions Judge, Bangalore, in Criminal Revision Petition No. 165 of 1995 and the order dated 1-6-1995 passed by the IX Additional C.M.M., Bangalore, in C.C. No. 1854 of 1988.
Being aggrieved by the orders passed by the learned XXIII Additional City Civil and Sessions Judge, Bangalore in Criminal Revision Petition No. 165 of 1995, the petitioner approached this Court under Section 482 of the Criminal Procedure Code. The learned Sessions Judge has passed the following order.-
"The revision petition field by the petitioner herein stands disposed of in the light of the observations made above. The learned Magistrate is directed to keep in mind the application filed by the petitioner herein under Section 340 of Criminal Procedure Code while disposing of the case on merits also".
From this order, it is clear that the petitioner will have full opportunity to contend before the Magistrate. The learned Counsel for the petitioner submits that by this time the application must have been disposed of.
Under that circumstance, viewed from any angle, I do not find any reasons to interfere with the impugned order passed by the learned XXIII Additional City Civil and Sessions Judge, in Criminal Revision Petition No. 165 of 1995.
Accordingly, this petition is dismissed.
