Judgment
(1) This petition under Article 226 of the Constitution of India has been filed seeking the following reliefs:-
''7(i) That, the respondents may kindly be directed to given protection to the petitioner ensure that the life, liberty and dignity of the petitioners are not put to jeopardy because of the acts of the respondent No.5.
(ii) That, the case of the petitoners considered in the judgment of Hon'ble Apex Court in the case of Lata Singh vs. State of Uttar Pradesh (AIR 2006 SC 2522)
(iii) That, the missing complaint filed by the respondent no.5 in the office of respondent no.4 may kindly be unaffected.
(2) It is submitted by the counsel for the petitioners that it is true that the petitioners have not married each other and they are living in live-in relationship and since they are major, therefore, nobody can be permitted to commit an offence against them.
(3) Heard the learned counsel for the petitioners.
(4) It appears that the petitioners are the residents of Punjab and their contention is that now they have come to Gwalior and residing at Gwalior. In the cause title of the petition, the petitioners have not given their local address. When a specific question was put to the counsel for the petitioners, then he submitted that the petitioners are constantly changing their address at Gwalior and at present, they are residing in Dabra. However, the counsel for the petitioner was not in a position to give the present address of the petitioners. Further, the entire cause of action has arisen in Punjab. Thus, it is clear that the petitioners are not only the residents of Punjab, but the entire cause of action has also arisen in Punjab. Even the petitioners have failed to establish that they have migrated to Gwalior. Under these circumstances, it is held that no cause of action has arisen within the territorial jurisdiction of this Court.
(5) Accordingly, this petition is dismissed with liberty to the petitioners that if so advised, they can approach the Court having the territorial jurisdiction.
