Judgment
V. Narasingh, J
This matter is taken up through hybrid mode.
Heard Mr. Sarangi learned senior counsel for the petitioner and Mr. S.N. Pattnaik, and Mr. D.K. Mohanty, learned Additional Government Advocates along with the counsel for Opposite Party No.1.
Mr. Diptesh Kumar Pattnayak, IPS, CMD OSRTC (Opposite Party No.2) appeared in person.
Registry is requested to trace the Vakalatnama filed by Mr. A. Tripathy, appeared for Opposite Party No.2 (Contemnor). His name be reflected in the cause list as well as in the file and also in the web portal of NIC.
It is submitted by Mr. Pattnaik, learned Additional Government Advocate that in terms of the order 02.08.2022 passed by this Court, Provisional Family Pension has been sanctioned in favour of the petitioner, which has been annexed at Annexure-A/1 to the show cause affidavit filed by the Contemnor No.1.
This Court had occasion to peruse the show cause and is constrained to express its disdain at the tone and tenor of the show cause.
Be that as it may, by Annexure-A/1 it is stated that Provisional Pension has been granted in favour of the widow petitioner w.e.f 1. 01.1996 to 31.12.2005 (Rs.1275/- + T.I. as admissible) and w.e.f. 1. 01.2006 to 31.12.2015 (Rs.3500/- + T.I. As admissible) and w.e.f. 1. 01.2016 onwards (Rs.8300/- + T.I. as admissible).
It is unequivocally stated by the learned counsel appearing for the State, Opposite Party No.1 as well as the CMD, OSRTC being present in person in the Court that steps shall be taken to pay the arrear as well as the current Provisional Pension to the petitioner (Smt. Lalita Mohanty) by 19th of September, 2022 at her place of residence and compliance to the effect shall be submitted by the next date.
List this matter on 21st of September, 2022 for further consideration.
A copy of this order be made over to the Mr. Pattnaik, learned Additional Government Advocate for facilitating the payment as undertaken.
List this matter on 22nd of September, 2022.
The personal appearance of the deponent as well as Mr. D.K. Pattnayak, IPS, CMD, OSRTC, is dispensed with for the time being.
