Judgment
Sudhanshu Dhulia, J.—The Petitioner is the mother of Late Ish Kumar, who was a constable in Indian Tibetan Boarder Police Force (from hereinafter referred to as ''ITBP''), who died on 15.05.2007. Since, before the post retirement benefits and other such benefits could be given to Smt. Reeta Devi - widow of Ish Kumar (i.e. daughter-in-law of the Petitioner), she also died on 03.12.2007 without any issue. Now, the only claimant left is the Petitioner, which is also admitted by the Respondents. The ITBP in its counter affidavit has stated that they have already given all the benefits to the Petitioner, except the G.P.F. final payment of Rs. 90,200/- and DLI (Deposit Link Insurance) of Rs. 60,000/-. They have fairly stated that this amount could not be given to the Petitioner, as the said amount was drawn in favour of Smt. Reeta Devi and after her death the said amount was received back.
Since, the liability has already been admitted by the Respondents, this Court directs the Respondents that the amount of Rs. 1,50,200/- (90200 + 60000) shall be given to the Petitioner without any further delay, as expeditiously as possible, but definitely within a period of three weeks from today.
With the aforesaid observation, the writ petition is disposed of.
No. order as to costs.
