Judgment
Learned counsel for the petitioner submits that the candidature of the petitioner is not being considered and has been rejected on the ground of overage. He submits that in an earlier writ petition bearing WPS No. 4097 of 2020, the respondent/State had filed its reply, on the basis of which the said writ petition was disposed of with an observation that the case of the petitioner would be considered in the near future. He further submits that at the time of filing of WPS No. 4097 of 2020 in the year 2020, the petitioner was not overage. He, therefore, prays that the petitioner may be permitted to submit a fresh representation before respondent No. 2/Secretary, Women and Child Development Department, Raipur (C.G.), seeking reconsideration of his candidature in the light of the earlier decision passed in WPS No. 4097 of 2020.
Learned State counsel appearing for the respondents has no objection to the prayer made by learned counsel for the petitioner.
In view of the submissions made by learned counsel for the parties and without entering into the merits of the case, the present writ petition is disposed of with liberty to the petitioner to submit a fresh representation before respondent No. 2/Secretary, Women and Child Development Department, Raipur (C.G.)
In the event the petitioner submits such representation along with a copy of this order and the relevant documents, respondent No. 2 shall consider and decide the same by passing a reasoned and speaking order, in accordance with law and keeping in view the decision of this Court in WPS No. 4097 of 2020, within a period of 50 days from the date of receipt of such representation.
Accordingly, the writ petition stands disposed of with the aforesaid liberty.
