By means of this writ petition moved under Article 226 of Constitution of India, the Petitioners have sought quashing of First Information Report dated 09.08.2011, registered as Crime No. 109 of 2011, relating to offences punishable u/s 498A, 323, 504, 313 of I.P.C. and one punishable u/s 3/4 Dowry Prohibition Act, 1961, Police Station-Nehru Colony, District Dehradun.

Learned Counsel for the Petitioners submitted that Petitioners have been falsely implicated in the criminal case, after premarital pregnancy of the complainant got detected However, serious allegations of demand of dowry, with full details, are made against the present Petitioners, and father-in-law of the complainant. As to the premarital pregnancy is concerned, it is a matter of investigation.

Having considered submissions of learned Counsel for the parties and after going through the papers on record, this Court is not inclined to interfere with the investigation of the case. The writ petition is dismissed summarily, with the observation that if the Petitioners namely Kanta Sharma and Pankaj Sharma, surrender before the court concerned, their bail application shall be heard and disposed of without unreasonable delay (Stay application No. 10120 of 2011, stands disposed of).
