Judgment
Sanjay Yadav, J.—Heard on admission.
Order dated 13.12.2012 passed in Hindu Marriage Case No. 72-A/2012 by First Additional District Judge to the Court of Additional Judge Hoshangabad (Link Court Itarsi), District Hoshangabad is being assailed vide this petition under Article 227 of the Constitution of India; whereby, an application by the petitioner u/s 24 of the Hindu Marriage Act, 1955 (hereinafter to be referred to as ''Act 1955'') for grant of maintenance pendente lite to the tune of Rs. 15,000/-per month, has been rejected.
Reasons for rejection of the application finds mention in paragraph 5 that petitioner/applicant has failed to establish from the documentary evidence that the respondent is earning more than Rs. 4,000/-per month.
The trial Court further finds that in a proceedings u/s 125 of the Criminal Procedure Code 1973, the petitioner has already been directed to be paid Rs. 2,000/-per month for her and her daughter''s maintenance.
No material documents have been brought on record to establish that the findings arrived at by the trial Court is perverse.
In view whereof, the conclusion arrived at by the trial Court in paragraph 5 does not warrant any interference.
Consequently petition fails and is dismissed.
