Judgment
By way of the present writ petitions, the petitioners have
prayed directions to the respondents for providing appropriate
appointment, as they stood in the select list.
During the pendency of the present writ petitions, the
respondents have stated that the appointment to the petitioner
could not be granted, as there was an interim order by the Hon''ble
Supreme Court in Special Leave Petitions (Civil) No. 23508 to
23513 titled as "State of Rajasthan Vs. Vikas Kumar Agarwal &
Ors.".
Mr. Vikas Choudhary, learned Associate of Mr. S.S. Ladrecha,
learned Additional Advocate General, informs the Court that the
said SLPs have been decided by the Hon''ble Supreme Court, vide
its order dated 18.10.2016 and the Hon''ble Supreme Court has
affirmed the stand of the State of Rajasthan. He further adds that
subsequent thereof, the result of Teacher Grade-III, 2013 has
been revised, pursuant to two judgments in the case of Dheeraj &
Anr. Vs. State and Niranjan Lal Vs. State.
After decision of the said SLP, which was pending before the
Hon''ble Supreme Court, there is no impediment in the way of the
Respondents. Hence, the Respondents are directed to proceed in
the matter and offer appointment to the Petitioners, if they fall in
merit list, after the revision of the result.
Needless to clarify that the Petitioners'' case shall be
considered in accordance with the revised result.
With the directions aforesaid, all the six the writ petitions
stand disposed of.
