A.N. Venugopala Gowda, J.—Petitioner is the Plaintiff and the Respondents are the Defendants in O.S.41/2006 on the file of Civil Judge (Sr. Dn.,), Kundapura. The suit was for partition and separate possession. By a judgment and decree dated 31.8.2010, the suit was dismissed. The Petitioner has filed an appeal in the District Court, Udupi on 22.9.2010. Along with the appeal, she has filed I. As.1 to 3. These writ petitions are to direct the appellate Court to register the appeal and decide I. As.1 to 3 expeditiously.

Notice of these writ petitions was issued to the Respondents and a copy was also ordered to be served on the learned Counsel who appeared for the Respondents in the Trial Court. Hand summons have been served on Respondent No. 2. Copies of writ petitions have been served on the learned Counsel who appeared for Respondent No. 1 in the appeal. There is no appearance.

Keeping in view the nature of relief sought in the writ petitions, it would be appropriate to direct the appellate Court to pass orders on the pending applications, as early as practicable and at any event, within a period of 4 weeks from the date a copy of this order is supplied to it.

Since vacation is intervening, it is open to the Petitioner to move the vacation Court and seek urgent reliefs, if any, in the appeal which is pending before the appellate Court.

Writ petitions stand disposed of accordingly.
