P.K. Misra, J.—Heard the learned counsel appearing for the parties. Though this application was listed for considering the miscellaneous

petition for direction, since the question involved is the same, the writ petition itself is taken up for disposal with the consent of the counsel

appearing for the parties.

The petitioner herein has prayed for a writ of mandamus to direct the second respondent to implement the decision of the third respondent. It

appears that the petitioner had filed an appeal before the third respondent, who has allowed the same. The grievance of the petitioner is that the

aforesaid order has not been enforced.

The learned counsel appearing for the respondents submitted that the order is to be complied with, subject to verification of documents to be

produced by the petitioner and on payment of tax.

Having regard to the facts and circumstances of the case, I dispose of the writ petition with the following direction.

The present petitioner shall produce all the relevant documents within one week, if not already produced and on such production of the documents,

appropriate direction shall be issued by the second respondent for implementation of the decisions of the third respondent and necessary permit

shall be issued with effect from 1.3.2002. If the petitioner is required to pay any of the amounts towards tax or any other legal dues, that should be

paid. Subject to the aforesaid direction, this writ is disposed of. No costs. Consequently, connected WPMP is closed.
