Judgment
N.K. Patil, J.—When this matter had come up for orders for taking steps and awaiting notice to respondent No. 6 on 31.03.2009, matter was adjourned to today with a direction to the learned Government Pleader appearing for respondents-1 to 5 to serve notice by hand summons to the 6th respondent through the 5th respondent. Accordingly, he has filed a memo dated 02.04.2009 stating that the hand summons has been served to respondent No. 6 on 31.03.2009 and accordingly respondent No. 6 Smt. Shaku S. Kamath is present before the Court. The said memo is placed on record.
Though this matter is posted in the orders list, having regard to the nature of the relief sought in the writ petition filed by the party in person, matter stands disposed of with the consent of the petitioner, party in person, learned Government Pleader and respondent No. 6, party in person who is also present before the Court,
Petitioner, party in person has sought for a direction to the police authorities to restore to the petitioner all her effects and belongings of which she was forcibly dispossessed without due process of law on 04.04.2008 as detailed in her complaint vide Annexure-A and as per the list Annexure-B which are retained by the police. She has further sought for a direction to the 2nd respondent to inquire into the case of the petitioner in the interest of justice and equity. The petitioner, party in person submits that she will go along with two assistants to collect the belongings and other material available in the house (I Floor) of the suit schedule property with the assistance of the police authorities,
In the light of this submission, the 6th respondent-party in person fairly submitted that she has no objection for the petitioner going over with two assistants to collect her belongings under the supervision of the jurisdictional police.
In the light of the submission made by the petitioner, party in person and the 6th respondent, party in person, without expressing any opinion on merits, it would suffice for this Court if appropriate direction is given to the 5th respondent-Inspector of Police, Maleswaram Police Station, Bangalore to accompany the petitioner, party in person with two other constables including two assistants of the petitioner, party in person to visit the suit schedule property and permit the petitioner, party in person to take out her belongings including the articles if any, and the 6th respondent is directed to co-operate in this regard. The petitioner along with her two assistants and the Inspector of Police with two constables are directed to visit the 6th respondent''s house on 04.04.2009 at 11.00 a.m. and the 5th respondent is directed to carry out the direction as referred to above. With these observations, the writ petition stands disposed of
Learned Government Header is given four weeks time to file his memo of appearance.
