Present writ petition has been filed under Article 226/227 of the Constitution of India for the issuance of a writ in the nature of mandamus directing respondent No.2 to consider and dispose of its legal notice dated 21.07.2023 (Annexure P-5).
Learned counsel for the petitioner has submitted that as per Rule 80-A of the Punjab Motor Vehicle Rules, 1989, in case, a holder of a permit has spare different permits on the same route, then, he can apply to the RTA concerned for clubbing those permits with the same number of return trips, but the authorities in a large number of cases have even clubbed permits, which pertained to different route. It is submitted that the petitioner be permitted to withdraw the present writ petition with liberty to seek an alternative remedy in accordance with law under the Motor Vehicle Act, 1988, after impleading the said persons in whose favour the alleged clubbing has been done.
In view of the above statement of learned counsel for the petitioner, the present writ petition is dismissed as withdrawn, with the aforesaid liberty.
