Venkataswami, J.—The petitioner''s application for the grant of stage carriage permit was not favourably disposed of by the authorities

below. Hence this revision. Pending disposal of this revision petition, new Motor Vehicles Act has come into force. It is stated, the Supreme Court

has held in C.A. 3381-82 of 1989 that the provisions of new Motor Vehicles Act will have to be taken into account while disposing of the pending

cases. Learned counsel on both sides agreed that in the light of the new provisions in the Motor Vehicles Act, 1988 and also the ruling of the

Supreme Court in Civil Appeal No. 3381-82 of 1989 (P.C.P. Radhakrishnan v. N. Krishnaswamy Chetty and another), the petitioner''s

application will have to be considered once again by the Regional Transport Authority.

Accordingly, while confirming the grant in favour of the respondent, the Regional Transport Authority is directed to consider the application of

the petitioner once again in the light of the provisions of the Motor Vehicles Act, 1988. The Regional Transport Authority will consider the

application within three months from the date of receipt of a copy of this order. The revision petition is accordingly allowed, and remanded. No

costs.
