Sale, J.—I think the best course is to make the order, but I wish it to be understood that I do so without deciding the question whether the assignment is a good assignment. There is only the fact that the assignment was executed. I think I ought to make the order with the object of enabling the assignee, not to interfere and raise issues between himself and the assignor but with the object of preventing his claim from being prejudiced. I understand this course has been adopted by Jenkins, J., and though I was not at first "disposed to take that course, I think no harm can be done in making the order. Costs reserved.
